Question 1455: My husband has recently denied Islam, the Quran, and the Ahl al-Bayt, peace be upon them. What is my duty regarding him?

✅ Answer: Pay attention to the following narrations:

1⃣ عَنِ ابْنِ مَحْبُوبٍ عَنْ هِشَامِ بْنِ سَالِمٍ عَنْ عَمَّارٍ السَّابَاطِیِّ قَالَ سَمِعْتُ أَبَا عَبْداللَّه یَقُولُ کُلُّ مُسْلِمٍ بَیْنَ مُسْلِمَیْنِ ارْتَدَّ عَنِ الْإِسْلَامِ وَ جَحَدَ رَسُولَ اللَّهِ نُبُوَّتَهُ وَ کَذَّبَهُ فَإِنَّ دَمَهُ مُبَاحٌ لِمَنْ سَمِعَ ذَلِکَ مِنْهُ وَ امْرَأَتَهُ بَائِنَةٌ مِنْهُ یَوْمَ ارْتَدَّ وَ یُقْسَمُ مَالُهُ عَلَی وَرَثَتِهِ وَ تَعْتَدُّ امْرَأَتُهُ عِدَّةَ الْمُتَوَفَّی عَنْهَا زَوْجُهَا وَ عَلَی الْإِمَامِ أَنْ یَقْتُلَهُ إِنْ أَتَوْهُ بِهِ وَ لَا یَسْتَتِیبَهُ.

Ammar Sabati says: I heard Imam Sadiq, peace be upon him, say: Any Muslim who is born between two Muslim parents and turns away from Islam, denies the prophethood of the Messenger of Allah, peace and blessings be upon him and his family, and contradicts him, his blood is lawful for anyone who hears it from him. On the very day he becomes an apostate, his wife is permanently separated from him, his wealth is divided among his heirs, his wife observes the waiting period of a woman whose husband has died, and it is incumbent upon the Imam to execute him if he is brought before him, without seeking his repentance!

2⃣عَنِ الْعَلَاءِ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ: سَأَلْتُ أَبَا جَعْفَرٍ عَنِ الْمُرْتَدِّ فَقَالَ مَنْ رَغِبَ عَنِ الْإِسْلَامِ وَ کَفَرَ بِمَا أُنْزِلَ عَلَی مُحَمَّدٍ بَعْدَ إِسْلَامِهِ فَلَا تَوْبَةَ لَهُ وَ قَدْ وَجَبَ قَتْلُهُ وَ بَانَتْ مِنْهُ امْرَأَتُهُ وَ یُقْسَمُ مَا تَرَکَ عَلَی وُلْدِهِ.

Muhammad ibn Muslim says: I asked Imam Sadiq, peace be upon him, about an apostate; the Imam said: Whoever turns away from Islam and, after accepting Islam, disbelieves in what was revealed to Muhammad, peace and blessings be upon him and his family, there is no repentance for him, his execution is obligatory, his wife is permanently separated from him, and his wealth is divided among his children!

3⃣ عَنِ ابْنِ مَحْبُوبٍ عَنْ هِشَامِ بْنِ سَالِمٍ عَنْ عَمَّارٍ السَّابَاطِیِّ قَالَ سَمِعْتُ أَبَا عَبْدِ اللَّهِ یَقُولُ کُلُّ مُسْلِمٍ بَیْنَ مُسْلِمَیْنِ ارْتَدَّ عَنِ الْإِسْلَامِ وَ جَحَدَ مُحَمَّداً نُبُوَّتَهُ وَ کَذَّبَهُ فَإِنَّ دَمَهُ مُبَاحٌ لِکُلِّ مَنْ سَمِعَ ذَلِکَ مِنْهُ وَ امْرَأَتَهُ بَائِنَةٌ مِنْهُ یَوْمَ ارْتَدَّ فَلَا تَقْرَبْهُ وَ یُقْسَمُ مَالُهُ عَلَی وَرَثَتِهِ وَ تَعْتَدُّ امْرَأَتُهُ [بَعْدُ] عِدَّةَ الْمُتَوَفَّی عَنْهَا زَوْجُهَا وَ عَلَی الْإِمَامِ أَنْ یَقْتُلَهُ وَ لَا یَسْتَتِیبَهُ.

Ammar says: I heard Imam Sadiq, peace be upon him, say: Any Muslim who is born between two Muslim parents and turns away from Islam, denies the prophethood of Muhammad, peace and blessings be upon him and his family, and contradicts him, his blood is lawful for anyone who hears it from him. On the day he becomes an apostate, his wife is permanently separated from him, so she should not approach her husband, his wealth is divided among his heirs, his wife observes the waiting period of death, and it is incumbent upon the Imam to execute him without granting him repentance!

✅ Based on the above narrations and others, a Muslim whose parents were both Muslims and who turns away from Islam is called a 'fitri apostate' (innate apostate). This apostasy can occur in various forms, such as:

انکار اللَّهِ عَزَّوَجَلَّ

Denying or contradicting the Holy Quran,

Denying the prophethood of the Messenger of Allah, peace and blessings be upon him and his family,

Contradicting the Messenger of Allah, peace and blessings be upon him and his family,

Becoming Christian, Jewish, Zoroastrian, atheist, insulting or denying the Ahl al-Bayt, peace be upon them, denying prayer, fasting, Hajj, etc.

✅ According to the above narrations and others, if a man becomes an apostate, from the very day of his apostasy, his wife is permanently separated from him, she must not approach her husband, and from that moment, she observes the waiting period of death, which is four months and ten days, and he becomes forbidden to her. The wealth of the apostate man is also divided among his heirs according to inheritance laws.

✅ Therefore, a believing and Muslim woman whose husband has fallen into apostasy cannot, under any circumstances, remain with such a husband.

✅ Nowadays, with the rise of apostasy among Muslim men and the negligence of their wives and those around them regarding its rulings and consequences, women whose husbands have become apostates are living with their apostate husbands in a forbidden manner, leading to illicit relationships and corruption of lineage!

✅ Isn’t it time we prayed more fervently for the hastening of the relief (faraj)?!

اللَّهُمَّ صَلِّ عَلَی مُحَمَّدٍ وَ آلِ مُحَمَّدٍ وَ عَجِّلْ لِوَلِیِّکَ الْفَرَجَ وَ الْعَافِیَةَ وَ النَّصْر
