Question 1407: Does a ceremonial divorce without intention take effect?

هَلْ یَقَعُ الْطَّلَاقُ بِغَیْرِ نِیَّةٍ وَ إِرَادَةٍ؟

✅Answer: Please pay attention to the following narrations:

1 عَنْ عَبْدِ اللَّهِ بْنِ بُکَیْرٍ عَنْ زُرَارَةَ عَنِ الْیَسَعِ قَالَ سَمِعْتُ أَبَا جَعْفَرٍ یَقُولُ فِی حَدِیثٍ وَ لَوْ أَنَّ رَجُلًا طَلَّقَ عَلَی سُنَّةٍ وَ عَلَی طُهْرٍ مِنْ غَیْرِ جِمَاعٍ وَ أَشْهَدَ وَ لَمْ یَنْوِ الطَّلَاقَ لَمْ یَکُنْ طَلَاقُهُ طَلَاقاً.

Yasa' said: I heard Imam Baqir, peace be upon him, saying in a hadith: Indeed, if a man divorces according to the Sunnah and in a state of purity without intercourse, and he also takes a witness, but he does not have the intention and purpose of divorce, his divorce is not considered a divorce!

2 عَنْ زُرَارَةَ عَنِ الْیَسَعِ عَنْ أَبِی عَبْدِ اللَّهِ وَ عَنْ عَبْدِ الْوَاحِدِ بْنِ الْمُخْتَارِ عَنْ أَبِی جَعْفَرٍ أَنَّهُمَا قَالا لَا طَلَاقَ إِلَّا لِمَنْ أَرَادَ الطَّلَاقَ.

Imam Baqir and Imam Sadiq, peace be upon them, said: There is no divorce except for one who intends and aims for divorce!

3 عَنْ زُرَارَةَ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: لَا طَلَاقَ إِلَّا مَا أُرِیدَ بِهِ الطَّلَاقُ.

Imam Sadiq, peace be upon him, said: There is no divorce except what is intended and purposed for divorce!

4 عَنْ هِشَامِ بْنِ سَالِمٍ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: لَا طَلَاقَ إِلَّا لِمَنْ أَرَادَ الطَّلَاقَ.

Imam Sadiq, peace be upon him, said: There is no divorce except for one who intends and aims for divorce!

✅Based on the above narrations and others, one of the conditions for the validity of divorce is that the person divorcing has the intention and will to divorce. If all the conditions for divorce, such as witnesses and a state of purity without intercourse, etc., are met, and he even utters the formula of divorce, but he does not have the intention and will to divorce and intends a ceremonial divorce for specific goals and intentions, such as registering it in an identity card, etc., such a divorce is not considered a divorce, and the marriage will remain in effect.

✅It is necessary to mention that for the validity of a divorce, the existence of a real intention and will and purpose of divorce is required for the husband, even if he appoints another person as a proxy for the divorce. If the husband does not have the intention to divorce, the intention and will of the proxy are not sufficient, and for the validity of the divorce, both are required to have the intention and will and purpose.

اللَّهُمَّ صَلِّ عَلَی مُحَمَّدٍ وَ آلِ مُحَمَّدٍ وَ عَجِّلْ لِوَلِیِّکَ الْفَرَجَ وَ الْعَافِیَةَ وَ النَّصْر
