Answer

✅ Answer: Please pay attention to the following verse and narrations:

The fornicating man marries not but a fornicating woman or a polytheist; and as for the fornicating woman, none marries her except a fornicating man or a polytheist. And that has been forbidden to the believers!

📚 Surah An-Nur, verse 3

📚 Al-Faqih Vol. 3, p. 405

Zurarah said: I asked Imam al-Sadiq (peace be upon him) about the saying of Allah, the Almighty (in Surah An-Nur, verse 3) which says: 'The fornicating man marries not but a fornicating woman or a polytheist; and as for the fornicating woman, none marries her except a fornicating man or a polytheist'

He said: These were women who were famous for fornication and men who were famous for fornication. They were famous for fornication and known by it, and people today are in the same position. So whoever has had the 'hadd' (legal punishment) for fornication carried out on him or has become famous for fornication, it is not proper for anyone to marry him until his repentance is known!

📚 Al-Kafi Vol. 5, p. 355

Imam al-Baqir (peace be upon him) said regarding the saying of Allah, the Almighty, which says: 'The fornicating man marries not but a fornicating woman or a polytheist': These were men and women who were famous for fornication during the time of the Messenger of Allah (peace be upon him and his family), and Allah, the Almighty, forbade (marriage with) those men and women, and people today are in the same position. Whoever makes something of that (fornication) public or has the 'hadd' for fornication carried out on him, then do not marry him until his repentance is known!

📚 Al-Kafi Vol. 5, p. 355

Imam al-Sadiq (peace be upon him) said regarding the saying of Allah, the Almighty, which says: 'and as for the fornicating woman, none marries her except a fornicating man or a polytheist': Indeed, this matter is about public (fornication). Then he said: If a person fornicates and then repents, he can marry whoever he wishes!

📚 Al-Tahdhib Vol. 7, p. 327

Imam al-Sadiq (peace be upon him) said: Do not marry a woman who openly fornicates, and a man who openly fornicates is not married either, except after the repentance of both is known!

📚 Al-Kafi Vol. 5, p. 355

Ammar said: I asked Imam al-Sadiq (peace be upon him) if it is permissible for a man to marry a woman with whom he used to fornicate? If she follows him, then she is forbidden to him, and if she refuses (to accept the forbidden relationship), he can marry her!

📚 Al-Kafi Vol. 5, p. 356

Provided that he keeps his distance from her until her 'iddah' passes with the cleansing of her womb from the water of fornication, and it is permissible for him to marry her after he is certain of her repentance!

📚 Al-Tahdhib Vol. 7, p. 327

📚 Al-Tahdhib Vol. 7, p. 327

Abu Basir said: I asked the Imam (Imam al-Sadiq, peace be upon him) about a man who fornicates with a woman and then after that intends to marry her. He said: If the woman repents, it is permissible to marry her. I said: How can her repentance be known? He said: He should invite her to what was forbidden to them, so if she refuses (to accept the forbidden) and seeks forgiveness from the Lord, he will know her repentance!

📚 Al-Tahdhib Vol. 7, p. 253

Zurarah said: Ammar asked the Imam (peace be upon him) about a man who enters into a temporary marriage with a fornicating woman, and I was present. He said: There is no problem, and if it is another marriage (i.e., a permanent marriage), he must firmly close his door!

📚 Qurb al-Isnad p. 78

Ali ibn Ri'ab said: I asked Imam al-Sadiq (peace be upon him) about a fornicating woman whom a Muslim man marries. He said: Yes! What is there to prevent him?! But if he does so, he must close his door for fear of the child's matter!

✅ From the above verse and narrations, it is clear that one cannot marry a fornicating man or woman who has become famous for fornication or on whom the 'hadd' for fornication has been carried out, and marriage with such a person is forbidden, unless their repentance is known and proven.

✅ Also, according to the above narrations and others, if a man fornicates with a woman who has no husband and is not in her 'iddah', she does not become eternally forbidden to him, but after both of them repent and the 'iddah' for the cleansing of her womb has passed, he can marry her.

✅ Regarding a fornicating woman who is not famous for fornication and on whom the 'hadd' for fornication has not been carried out, permission to marry her has been given in several narrations, such as narrations 9, 10, and 11, but it has been instructed that the door must be closed on her so that no problem arises regarding the matter of the child.
