Imam al-Sadiq (peace be upon him) said: When a man marries a woman and divorces her before consummation, there is no ‘iddah upon her, and she may marry immediately, and that divorce counts as a bā’in (irrevocable) divorce!
2 عَن أَبِي الصَّبَّاحِ الْكِنَانِيِّ عَنْ أَبِي عَبْداللَّه قَالَ: إِذَا طَلَّقَ الرَّجُلُ امْرَأَتَهُ قَبْلَ أَنْ يَدْخُلَ بِهَا فَلَهَا نِصْفُ مَهْرِهَا إِلَى أَنْ قَالَ وَ لَيْسَ لَهَا عِدَّةٌ تَتَزَوَّجُ من شاءت مِنْ سَاعَتِهَا

Imam al-Sadiq (peace be upon him) said: If a man (in permanent marriage) divorces his wife before consummation, half of the dowry belongs to her… and there is no ‘iddah upon her, and she may marry immediately!
3 عن حَمَّادِ بْنِ عثمان عَنْ أَبِي عَبْداللَّه قَالَ: سَأَلْتُهُ عَنِ الَّتِي قَدْ يَئِسَتْ مِنَ الْمَحِيضِ وَ الَّتِي لَا يَحِيضُ مِثْلُهَا قَالَ لَيْسَ عَلَيْهَا عِدَّةٌ

Ḥammād said: I asked Imam al-Sadiq (peace be upon him) about a woman who has despaired of menstruation (menopausal) and one who, like her, does not menstruate; he said: There is no ‘iddah upon such a woman!

One of the two Imams al-Bāqir or al-Sadiq (peace be upon them) regarding a man who divorces a young girl who has not reached puberty and cannot become pregnant, said: There is no ‘iddah upon her, even if consummation took place!
5 عَنْ محمد بن مسلم قَالَ سَمِعْتُ أَبَاجَعْفَر يَقُولُ فِي الَّتِي قَدْ يَئِسَتْ مِنَ الْمَحِيضِ يُطَلِّقُهَا زَوْجُهَا قَالَ قَدْ بَانَتْ مِنْهُ وَ لَا عِدَّةَ عَلَيْهَا

Muḥammad ibn Muslim said: I heard Imam al-Bāqir (peace be upon him) regarding a woman who has reached menopause and whose husband divorces her; he said: She is separated from her husband irrevocably, and there is no ‘iddah upon her!
6 عَنْ عبدالرحمن بْنِ الْحَجَّاجِ قَالَ: قَالَ أَبُو عَبْداللَّه ثَلَاثٌ يَتَزَوَّجْنَ عَلَى كُلِّ حَالٍ الَّتِي لَمْ تَحِضْ وَ مِثْلُهَا لَا تَحِيضُ قَالَ قُلْتُ: وَ مَا حَدُّهَا قَالَ إِذَا أَتَى لَهَا أَقَلُّ مِنْ تِسْعِ سِنِينَ وَ الَّتِي لَمْ يُدْخَلْ بِهَا وَ الَّتِي قَدْ يَئِسَتْ مِنَ الْمَحِيضِ وَ مِثْلُهَا لَا تَحِيضُ قُلْتُ وَ مَا حَدُّهَا قَالَ إِذَا كَانَ لَهَا خَمْسُونَ سَنَةً

Imam al-Sadiq (peace be upon him) said: Three women can marry in any case (they have no waiting period):
– A girl who has not yet menstruated and is of the age that such does not menstruate. I asked: What is the limit? He said: When she is under nine years old.
– A woman who has not been consummated with.
– A woman who has despaired of menstruation (menopausal). I asked: What is the limit? He said: When she reaches fifty years!
7 حماد بن عثمان عمن رَوَاه عَنْ أَبِي عَبْداللَّه في الصَّبِيَّةِ الَّتِي لَا يَحِيضُ مِثْلُهَا وَ الَّتِي قَدْ يَئِسَتْ مِنَ الْمَحِيضِ قَالَ لَيْسَ عَلَيْهِمَا عِدَّةٌ و إِنْ دُخِلَ بِهِمَا

Imam al-Sadiq (peace be upon him) said regarding the young girl who does not menstruate and the woman who has reached menopause: There is no ‘iddah upon either, even if consummated!
✅ Based on the above narrations and others, three categories of women do not need to observe ‘iddah in either permanent or temporary marriage and may remarry immediately after divorce or expiration of the temporary contract:
1 A woman with whom no consummation occurred during the marriage.
2 A young girl under nine years old who has not menstruated.
3 A menopausal woman, defined in narrations as 50 years old, or 60 years old in the case of Nabataean and Qurayshi women (📚 Wasāʾil al-Shīʿa, vol. 2, p. 334, chapter 31).
