1 عَنْ زِيَادِ بْنِ أَبِي الْحَلَّالِ قَالَ سَمِعْتُ أَبَا عَبْدِ اللَّهِ يَقُولُ لَا بَأْسَ أَنْ يَتَمَتَّعَ الْبِكْرَ مَا لَمْ يُفْضِ إِلَيْهَا مَخَافَةَ كَرَاهِيَةَ الْعَيْبِ عَلَى أَهْلِهَا.

Ziyad says: I heard Imam Sadiq (peace be upon him) say: There is no problem if a person enters a virgin girl into temporary marriage, as long as he does not deflower her (remove her virginity), out of fear of the disgrace it might bring upon her family!

Abu Sa‘id says: Imam Sadiq (peace be upon him) was asked about temporary marriage with virgin girls who live with their father and mother. The Imam said: There is no problem, and I do not say what those vile men who have no goodness (meaning the Sunni jurists) say!

A man says: I asked Imam Sadiq (peace be upon him): A virgin girl living with her parents secretly invites me to temporary marriage with herself. Should I do it? He said: Yes! But avoid the place of the vagina!

He says: I asked: What if she agrees to that (meaning penetration)? He said: Even if she agrees, for this is a disgrace for virgin girls!

6 عَنِ الْحَلَبِيِّ قَالَ: سَأَلْتُهُ عَنِ التَّمَتُّعِ مِنَ الْبِكْرِ إِذَا كَانَتْ بَيْنَ أَبَوَيْهَا بِلَا إِذْنِ أَبَوَيْهَا قَالَ لَا بَأْسَ مَا لَمْ يَقْتَضَّ مَا هُنَاكَ لِتَعِفَّ بِذَلِكَ

Halabi says: I asked (Imam Sadiq, peace be upon him) about temporary marriage with a virgin girl who is living with her parents, without their permission. He said: As long as he does not remove what is there (her virginity), there is no problem, so that she may guard her chastity through it!

Muhammad ibn Muslim says: I asked (Imam Sadiq, peace be upon him) about a girl whom a man contracts temporary marriage with. The Imam said: Yes, unless she is a little girl who could be deceived!

Abd al-Malik says: I asked Imam Sadiq (peace be upon him) about temporary marriage; the Imam said: Its matter is difficult and severe, so refrain from virgin girls!

✅ From the above narrations and others, it is observed that in general, temporary marriage with a virgin girl is considered disliked (makruh) and discouraged. However, in other significant narrations, permission has been granted, and these permissions are also applicable. Although some narrations state the necessity of the father’s permission for her temporary marriage, other narrations permit temporary marriage with a virgin and mature girl without her father’s permission. But according to the above narrations, several points must be considered:

1 In temporary marriage with a virgin girl, permission for penetration and removal of virginity has not been given. It has been ordered to avoid the place of the vagina even if the girl herself consents. Therefore, under no circumstances should defloration occur.

2 The girl must not be a minor; she must be mature and have reached the age of ten.

3 There is no doubt that in the above narrations, temporary marriage with a virgin is mentioned as disliked (makruh), especially due to the issues of dissimulation (taqiyyah) and the shame and disgrace it may cause the girl’s family, both during the time of Ahl al-Bayt (peace be upon them) and in our time. Even though permission for this has been narrated, one must weigh the circumstances carefully so as not to act contrary to taqiyyah or cause various problems. Especially since most jurists in our time do not consider temporary marriage with a virgin without her father’s permission permissible.

4 The ruling of permanent marriage is different from temporary marriage.

5 Considering narration 5 1 , if temporary marriage with a virgin girl is done, it is much better if it is with her father’s permission whenever possible.

6 In conclusion, the proper practice of temporary marriage within its precise legal boundaries leads to a reduction in immorality. Unfortunately, however, the general view of people towards temporary marriage is negative, as if they prefer immorality over temporary marriage. Therefore, once again we must constantly and with great humility say:
