Question 830: Is it permissible to set the dowry for a permanent marriage at more than the 'Mahr al-Sunnah'?

1 عن عَبْداللَّهِ بْنِ سِنَانٍ عَنْ أَبِي عَبْدِ اللَّهِ قَالَ: كَانَ صَدَاقُ النِّسَاءِ عَلَى عَهْدِ النَّبِيِّ اثْنَتَيْ عَشْرَةَ أُوقِيَّةً وَ نَشّاً قِيمَتُهَا مِنَ الْوَرِقِ خَمْسُمِائَةِ دِرْهَمٍ.
📚 Al-Tahdhib, vol. 7, page 356
Imam Sadiq (peace be upon him) said: 'The dowry of women during the time of the Messenger of Allah (peace be upon him and his family) was 12.5 uqiyah, which is equivalent to 500 dirhams of silver!'
2 عَنْ خَالِدِ بْنِ نَجِيح عَنْ أَبِي عَبْداللَّه قَالَ: تَذَاكَرُوا الشُّؤْمَ عِنْدَ أَبِي فَقَالَ الشُّؤْمُ فِي ثَلَاثٍ فِي الْمَرْأَةِ وَ الدَّابَّةِ وَ الدَّارِ فَأَمَّا شُؤْمُ الْمَرْأَةِ فَكَثْرَةُ مَهْرِهَا وَ عُقْمُ رَحِمِهَا.

Imam Sadiq (peace be upon him) said: 'The misfortune and inauspiciousness were discussed in the presence of my father. So he said: 'Misfortune and inauspiciousness are in three things: in a woman, a mount, and a house. As for the misfortune and inauspiciousness of a woman, it is her high dowry and the barrenness of her womb....''
3 عن الصَّادِقِ جَعْفَرِ بْنِ مُحَمَّدٍ عَنْ أَبِيهِ عَنْ آبَائِهِ قَالَ: قَالَ رَسُولُ اللَّهِ أَفْضَلُ نِسَاءِ أُمَّتِي أَصْبَحُهُنَّ وَجْهاً وَ أَقَلُّهُنَّ مَهْراً

The Messenger of Allah (peace be upon him and his family) said: 'The best women of my Ummah are those who have the most beautiful and radiant faces and the lowest dowries!'
4 عَنْ عَلِيٍّ قَالَ: لَا تُغَالُوا بِمُهُورِ النِّسَاءِ فَتَكُونَ عَدَاوَةً.

Ali (peace be upon him) said: 'Do not make the dowries of women expensive and heavy, for this leads to enmity and hatred!'
5 عَنْ وَهْبِ بْنِ وَهْبٍ عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ عَنْ آبَائِهِ عَنْ عَلِيٍّ قَالَ: إِنِّي لَأَكْرَهُ أَنْ يَكُونَ الْمَهْرُ أَقَلَّ مِنْ عَشَرَةِ دَرَاهِمَ لِئَلَّا يُشْبِهَ مَهْرَ الْبَغِيِّ.

Ali (peace be upon him) said: 'I dislike a dowry (for a permanent marriage) to be less than ten dirhams so that it does not resemble the dowry of fornication!'
6 أَبِي الصَّبَّاح الْكِنَانِيِّ عن أَبِي عبداللَّه قَالَ: سَأَلْتُهُ عَنِ الْمَهْرِ مَا هُوَ قَالَ مَا تَرَاضَى عَلَيْهِ النَّاسُ

Abu Sabah said: I asked Imam Sadiq (peace be upon him) about the dowry, what is it? He said: 'Whatever the people agree upon and are satisfied with!'
7 عَنِ فُضَيْلِ بْنِ يَسَارٍ عَنْ أَبِي جَعْفَرٍ قَالَ: الصَّدَاقُ مَا تَرَاضَيَا عَلَيْهِ مِنْ قَلِيلٍ أَوْ كَثِيرٍ فَهَذَا الصَّدَاقُ.

Imam Baqir (peace be upon him) said: 'The sadaq and the dowry are whatever the two parties agree upon and are satisfied with, whether little or much, and this is the sadaq (dowry)!'
8 عَنِ الْحَلَبِيِّ عن أَبِي عَبْداللَّه قال: سَأَلْتُهُ عَنِ الْمَهْرِ فَقَالَ مَا تَرَاضَى عَلَيْهِ النَّاسُ أَوِ اثْنَتَا عَشْرَةَ أُوقِيَّةً وَ نَشٌّ أَوْ خَمْسُمِائَةِ دِرْهَمٍ

Halabi said: I asked Imam Sadiq (peace be upon him) about the dowry; he said: 'Whatever the people agree upon and are satisfied with, or 12.5 uqiyah, or 500 dirhams of silver!'
9 زُرَارَةَ بْنِ أَعْيَنَ عَنْ أَبِي جَعْفَر قال: الصَّدَاقُ كُلُّ شَيْ ءٍ تَرَاضَى عَلَيْهِ النَّاسُ قَلَّ أَوْ كَثُرَ فِي مُتْعَةٍ أَوْ تَزْوِيجٍ غَيْرِ مُتْعَةٍ

Imam Baqir (peace be upon him) said: 'The dowry is anything that people agree upon, whether little or much, in temporary marriage and in non-temporary marriage!'
10 عن الْوَشَّاء عن الرضا قال سَمِعْتُهُ يَقُولُ لَوْ أَنَّ رَجُلًا تَزَوَّجَ الْمَرْأَةَ و جَعَلَ مَهْرَهَا عِشْرِينَ أَلْفاً و جَعَلَ لِأَبِيهَا عَشَرَةَ آلَافٍ كَانَ الْمَهْرُ جَائِزاً و الَّذِي جَعَلَهُ لِأَبِيهَا فَاسِداً

Washa said: I heard Imam Reza (peace be upon him) say: 'If a man marries a woman and sets her dowry at 20,000 (dirhams) and sets 10,000 (dirhams) for her father, that dowry is permissible, and what he sets for her father is invalid!'
✅ From the above narrations and others, it is clear that what is recommended as a tradition for the dowry is 500 dirhams of silver. However, other amounts and things, whether little or much, that the two parties agree upon and are satisfied with, are also permissible for the dowry in permanent and temporary marriage. Of course, making the dowry expensive and heavy is severely condemned in many narrations, and a dowry of less than 10 dirhams is also disliked.
What is mentioned in one or two anomalous narrations that a dowry of more than 500 dirhams is not permissible and cannot be paid contradicts numerous narrations, and the knowledge of it is referred back to the Ahl al-Bayt (peace be upon them).
