1 عَنْ زُرَارَةَ بْنِ أَعْيَنَ قَالَ: سَأَلْتُ أَبَا جَعْفَرٍ عَنْ قَوْلِ اللَّهِ عَزَّ وَ جَلَّ وَ الْمُحْصَناتُ مِنَ الَّذِينَ أُوتُوا الْكِتابَ مِنْ قَبْلِكُمْ فَقَالَ هِيَ مَنْسُوخَةٌ بِقَوْلِهِ وَ لا تُمْسِكُوا بِعِصَمِ الْكَوافِرِ

Zurarah said: I asked Imam Baqir, peace be upon him, about the Divine statement (in Surah Al-Ma'idah, verse 5) which says:

'And the chaste women from those who were given the Book before you (were made lawful for you).' The Imam said: This verse has been abrogated by the Divine statement (in Surah Al-Mumtahinah, verse 10) which says: 'Do not hold on to the bonds (of marriage) of disbelieving women.'

2 عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ قَالَ: سَأَلْتُهُ عَنْ نَصَارَى الْعَرَبِ أَ تُؤْكَلُ ذَبَائِحُهُمْ فَقَالَ كَانَ عَلِيٌّ بن الحسین يَنْهَى عَنْ ذَبَائِحِهِمْ وَ عَنْ صَيْدِهِمْ وَ عَنْ مُنَاكَحَتِهِمْ.

Muhammad ibn Muslim said: I asked Imam Baqir, peace be upon him, about the Arab Christians, whether their slaughtered animals are to be eaten? The Imam said: Ali ibn al-Husayn, meaning Imam Sajjad, peace be upon him, used to forbid their slaughtered animals, their game, and marrying them!

3 عَنِ الْحَسَنِ بْنِ الْجَهْمِ قَالَ: قَالَ لِي أَبُو الْحَسَنِ الرِّضَا يَا أَبَا مُحَمَّدٍ مَا تَقُولُ فِي رَجُلٍ تَزَوَّجَ نَصْرَانِيَّةً عَلَى مُسْلِمَةٍ قَالَ قُلْتُ: جُعِلْتُ فِدَاكَ وَ مَا قَوْلِي بَيْنَ يَدَيْكَ قَالَ لَتَقُولَنَّ فَإِنَّ ذَلِكَ يُعْلَمُ بِهِ قَوْلِي قُلْتُ لَا يَجُوزُ تَزْوِيجُ النَّصْرَانِيَّةِ عَلَى مُسْلِمَةٍ وَ لَا غَيْرِ مُسْلِمَةٍ قَالَ وَ لِمَ قُلْتُ لِقَوْلِ اللَّهِ عَزَّ وَ جَلَّ وَ لا تَنْكِحُوا الْمُشْرِكاتِ حَتَّى يُؤْمِنَّ قَالَ فَمَا تَقُولُ فِي هَذِهِ الْآيَةِ وَ الْمُحْصَناتُ مِنَ الَّذِينَ أُوتُوا الْكِتابَ مِنْ قَبْلِكُمْ قُلْتُ فَقَوْلُهُ وَ لا تَنْكِحُوا الْمُشْرِكاتِ- نَسَخَتْ هَذِهِ الْآيَةَ فَتَبَسَّمَ ثُمَّ سَكَتَ.

Hasan ibn Jahm said: Imam Reza, peace be upon him, said to me: What do you say about a man who marries a Christian woman while having a Muslim wife? I said: May I be your ransom! What is the place of my saying in front of you?! The Imam said: You must say it, for my saying about it will be clarified by that statement!

I said: It is not permissible to marry a Christian woman while having a Muslim or a non-Muslim wife!

The Imam said: Why?

I said: Because of the saying of Allah, the Mighty and Exalted (in Surah Al-Baqarah, verse 221) which says: 'Do not marry polytheistic women until they believe.'

The Imam said: So what do you say about this verse (in Surah Al-Ma'idah, verse 5) where Allah says: 'The chaste women from those who were given the Book before you (are made lawful for you)'?

I said: The saying of Allah (in Surah Al-Baqarah, verse 221) which says: 'Do not marry polytheistic women until they believe,' has abrogated this verse!

Hasan ibn Jahm said: The Imam smiled and then fell silent!

4 عَنْ زُرَارَةَ بْنِ أَعْيَنَ عَنْ أَبِي جَعْفَرٍ قَالَ: لَا يَنْبَغِي نِكَاحُ أَهْلِ الْكِتَابِ قُلْتُ جُعِلْتُ فِدَاكَ وَ أَيْنَ تَحْرِيمُهُ قَالَ قَوْلُهُ وَ لا تُمْسِكُوا بِعِصَمِ الْكَوافِرِ

Zurarah said: Imam Baqir, peace be upon him, said: It is not appropriate to marry the people of the Book. I said: May I be your ransom, where is its prohibition? The Imam said: The Divine statement (in Surah Al-Mumtahinah, verse 10) which says: 'Do not hold on to the bonds (of marriage) of disbelieving women.'

5 عَنْ عَبْدِ اللَّهِ بْنِ سِنَانٍ عَنْ أَبِي عَبْدِ اللَّهِ فِي حَدِيثٍ قَالَ: وَ مَا أُحِبُّ لِلرَّجُلِ الْمُسْلِمِ أَنْ يَتَزَوَّجَ الْيَهُودِيَّةَ وَ لَا النَّصْرَانِيَّةَ مَخَافَةَ أَنْ يَتَهَوَّدَ وُلْدُهُ أَوْ يَتَنَصَّرَ.

Imam Sadiq, peace be upon him, said in a hadith: I do not like for a Muslim man to marry a Jewish or Christian woman, for fear that his children may become Jewish or Christian!

6 عَنْ أَبِي الْجَارُودِ عَنْ أَبِي جَعْفَرٍ فِي قَوْلِهِ وَ لا تُمْسِكُوا بِعِصَمِ الْكَوافِرِ يَقُولُ مَنْ كَانَتْ عِنْدَهُ امْرَأَةٌ كَافِرَةٌ يَعْنِي عَلَى غَيْرِ مِلَّةِ الْإِسْلَامِ- وَ هُوَ عَلَى مِلَّةِ الْإِسْلَامِ فَلْيَعْرِضْ عَلَيْهَا الْإِسْلَامَ- فَإِنْ قَبِلَتْ فَهِيَ امْرَأَتُهُ وَ إِلَّا فَهِيَ بَرِيئَةٌ مِنْهُ فَنَهَى اللَّهُ أَنْ يُمْسِكَ بِعِصْمَتِهَا.

📚 Tafsir al-Qummi, Vol. 2, p. 363

Imam Baqir, peace be upon him, regarding the saying of Allah (in Surah Al-Mumtahinah, verse 10) which says: 'Do not hold on to the bonds of marriage of disbelieving women,' said: Whoever has a disbelieving wife, meaning not on the religion of Islam, while that man is on the religion of Islam, must present Islam to that woman. If she accepts, she is considered his wife, and if she does not accept, that woman is free and separate from him, and Allah has forbidden holding on to her marriage bond!

✅It is clear from the above narrations and their like that it is forbidden and invalid to marry disbelieving and non-religious men and women, and in the above narrations, marriage to the people of the Book, such as Jewish and Christian women, is also declared forbidden.

However, several narrations have been reported allowing marriage to the people of the Book, but due to their contradiction with the firm and un-abrogated verses of the Quran and their contradiction with precaution and their agreement with the general public, they are not to be acted upon, and their knowledge is rejected by the Ahl al-Bayt, peace be upon them.

7 عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ فِي حَدِيثٍ قَالَ: لَا يَنْبَغِي لِلْمُسْلِمِ أَنْ يَتَزَوَّجَ يَهُودِيَّةً وَ لَا نَصْرَانِيَّةً وَ هُوَ يَجِدُ مُسْلِمَةً حُرَّةً أَوْ أَمَةً.

Imam Baqir, peace be upon him, said: It is not appropriate for a Muslim man to marry a Jewish or Christian woman, while he can find a free or slave Muslim woman!

8 عَنْ يُونُسَ عَنْهُمْ قَالَ: لَا يَنْبَغِي لِلْمُسْلِمِ الْمُوسِرِ أَنْ يَتَزَوَّجَ الْأَمَةَ إِلَّا أَنْ لَا يَجِدَ حُرَّةً وَ كَذَلِكَ لَا يَنْبَغِي لَهُ أَنْ يَتَزَوَّجَ امْرَأَةً مِنْ أَهْلِ الْكِتَابِ- إِلَّا فِي حَالِ ضَرُورَةٍ حَيْثُ لَا يَجِدُ مُسْلِمَةً حُرَّةً وَ لَا أَمَةً.

Yunus narrated from the Ahl al-Bayt, peace be upon them, that they said: It is not appropriate for a wealthy Muslim to marry a slave woman, unless he cannot find a free woman, and it is also not appropriate for him to marry a woman from the people of the Book, except in a state of necessity, such that he cannot find any free or slave Muslim woman!

9 عَنْ زُرَارَةَ بْنِ أَعْيَنَ قَالَ: سَأَلْتُ أَبَا جَعْفَرٍ عَنْ نِكَاحِ الْيَهُودِيَّةِ وَ النَّصْرَانِيَّةِ فَقَالَ لَا يَصْلُحُ لِلْمُسْلِمِ أَنْ يَنْكِحَ يَهُودِيَّةً وَ لَا نَصْرَانِيَّةً إِنَّمَا يَحِلُّ مِنْهُنَّ نِكَاحُ الْبُلْهِ.

Zurarah said: I asked Imam Baqir, peace be upon him, about marrying a Jewish and a Christian woman. The Imam said: It is not good for a Muslim to marry a Jewish and a Christian woman, for only marriage with weak-minded women (i.e., the oppressed women) from among them is lawful.

✅According to the three above narrations and some other narrations, in a state of necessity where no Muslim woman can be found, marriage to oppressed Jewish and Christian women is permitted, which of course, this necessity occurs very rarely.
